Admiral ® Fasih Bukhari, Chairman National Accountability Bureau (NAB) Friday filed an intra-court appeal against Supreme Court’s contempt notice issued on March 20. The intra-court appeal was filled through Sardar Muhammad Litif Khan Khosa the counsel for Chairman NAB, he stated in the petition that all proceeding by three-judge bench headed by Chief Justice Iftikhar Muhammad Chaudhary were illegal, ab-initio, void and corum non-judice.
He stated in his intra-court appeal that the contempt notice was given his client under the Contempt of Court Ordinance, 2003, a law which itself had lapsed and was substituted by Ordinance No, 1 of 2004 which was also expired.
He further stated that later a Contempt of Court Act, 2012 was passed by the Parliament which was also struck down and declared “ultra viries” of Constitution of Pakistan by the Supreme Court itself.
Giving the reference of similar contempt case of Inspector General Police (IGP) Islamabad, whom convection was suspended and his petition was admitted for hearing under Ordinance (iv) of 2003. He categorically stated in his petition that when there is no such law of Contempt of Court in the field then how charge could be framed against his client.
Petition positively stated that because there is no such law of contempt , so, all the proceeding by three-judge bench headed by Chief Justice Iftikhar Muhammad Chuadhary were illegal and void.
