Balochistan unrest case: Legislating, not obtaining funds, job of elected representatives, says CJP

Chief Justice of Pakistan (CJP) Iftikhar Muhammad Chaudhry has remarked legislating, not obtaining funds is job of elected representatives.

CJP gave these remarks while presiding over a 3-member bench of Supreme Court (SC) during the course of hearing of Balochistan unrest case here Wednesday.

Aman Ullah Kanrani appeared on behalf of government of Balochistan while Iftikhar Gilani and others represented the petitioner.

Report with regard to development funds for Balochistan was presented in the court. The court expressed dissatisfaction over it.

Iftikhar Gilani appeared on behalf of government of Balochistan when the hearing of case with reference to uplift schemes of Balochistan was started.

Iftikhar Gilani took the plea these all schemes were of individual nature development schemes. Justice Gulzar remarked was the law not kept in view while awarding the contract.

Justice Azmat Saeed observed “criminal negligence has been committed in the province as per report of Balochistan officer.

Iftikhar Gilani said “we have filed the report. Whosoever is involved be proceeded against. CJP inquired how the development schemes are allocated to elected representatives.

Justice Gulzar remarked “250 million rupees are provided out of development fund and it is known to everyone.

CJP remarked “ legislating is job of elected representatives rather than obtaining funds. We can assign to NAB to hold investigation into these projects”.

Iftikhar Gilani said parliamentarians’ use the funds on their own instead of the institutions in most of the projects.

CJP remarked people of Balochistan are suffering from sense of deprivation, therefore, the situation is not better in the province. Public deprivations are root cause of ills in Balochistan.

Iftikhar Gilani said billion of rupees are being embezzled. This is opportune time that government controls the situation before the installation of next government and the court should assist it. Besides discretionary funds, licenses, quota and several other quotas are given to the parliamentarians.

Justice Azmat remarked “this practice was started since Zia rule after 1985. List of the persons be provided to us against whom the action has been initiated on misuse of funds.

CJP remarked “there are only a few persons who are enjoying Where the amount provided under NFC award has gone. No drinking water and medicine is available to people of Balochistan. Bribery is given in the matters of transfer and jobs. Only money matters in Balochistan for all. Balochistan should be more developed province than others on the basis of quantum of money which is provided to it under development fund.

Iftikhar Gilani said cost of construction of a road has reached the figure of 11 billion rupees. NAB is investigating this matter.

Additional advocate general told that Balochistan government had imposed ban on the project that the job will be done by one to whom it has been assigned.

CJP remarked this has been done after we have issued orders. Tell the court wherefrom funds are released to members of parliament as per constitution. Who released these funds.

Aman Ullah Kanrani said amount is earmarked in the budget on this count. Share is given to MPA too.

CJP observed “ tell us as per rules of business”. Even a single pie out of public wealth cannot be embezzled. Cases have been referred to NAB and police. Ask from them what has been done about these cases and inform the court thereof. Withholding the amount is wrong. MPA should only inform about the projects related to their respective constituencies and funds be not given to them.

Justice Azmat Saeed remarked “ ministers have shifted all development schemes to their respective constituencies. Development works be got done but distribution of funds be made equitably.
