French police had identified the paparazzo who snapped Kate Middleton topless and were preparing to arrest him, media reported.

The photographer created headlines after snapping photos of Middleton topless during a romantic holiday with husband Prince William at a villa in Provence.

The topless shots of Middleton were published in French magazine Closer then in Italy, Ireland and on the internet, despite the Royal couple's efforts to halt their usage.

The name of the photographer has now been passed on to detectives investigating the alleged crime following the issuing of a court order in Paris, the Daily Mail reported.

After at first expressing "disappointment," William called for the photographer to be jailed, which according to the Mail may happen thanks to France's strict privacy laws.

The photographer also faces a $58,000 fine.

Celebs.com cited "an insider" as saying:

"William and Kate are determined to bring the person who took those photos to justice and they're pushing hard for a custodial sentence. They want to make an example of this person."

Meantime, Marie Claire magazine cited long-lens photographer Pascal Rostain as saying that Closer had chosen a British photographer living in France to snap Middleton at the chateau.

Rostain said the photographer was on salary for the job.

While no media were naming the photographer, the Daily Mail reported that Marie-Christine Daubigney, the French public prosecutor dealing with the case, had the name.
